Considering about "Judicial Interpretation" on criminal cases about tobacco monopoly commodities

阐述了出台《关于办理非法生产、销售烟草专卖品等刑事案件具体应用法律若干问题的解释》(以下简称《司法解释》)的背景以及刑法对烟草专卖制度本身提供直接保护的几个方面,通过对实践打击涉烟犯罪中法律适用问题的剖析,提出要正确运用《司法解释》对刑法第225条的规定,打击非法生产、销售烟草专卖品的犯罪活动。

Background with regard to the issue of ＂Judicial Interpretation＂ was reviewed and the Criminal Law＇s protective effect on tobacco monopoly system was elaborated. The application of law in practices in fighting against tobacco-related crimes was analyzed. The proper application of ＂Judicial Interpretation＂ to item 225 of the Criminal Law was put forward in fighting against illegal production and sales of tobacco monopolized commodities.
