我国反腐追逃中的移民法遣返措施初探

Preliminary Exploration on Measures of Immigration Repatriation in China Anti-corruption Pursuit

境外追逃是反腐败国际司法合作的重要内容。作为引渡替代措施的移民法遣返,对于完善反腐败国际合作的措施和机制,惩治和预防跨国腐败犯罪,具有重要意义。移民法遣返措施的补充性、单方性及追逃国的辅助性等特征明显,具有适用简便、灵活以及追逃国举证责任较小等优势,也存在一些弊端。应进一步完善我国移民法遣返的途径,以更好地促进我国反腐追逃工作的深入开展,有效提升反腐败国际合作的水平。

Overseas pursuit is the important content of the international judicial cooperation. As extradition alternative measures, the immigrate repatriation plays an important role to improve the international anticorruption cooperation measures and mechanisms, to punish and prevent cross-corruption. The characteristics of immigrate repatriation measures are apparently in complementary, one-sidedness and subservience with the advantages of simple, flexible and less evidential burden, but it also has some disadvantages. This paper suggests that we should improve the immigration repatriation approaches in order to promote China＇s anticorruption pursuit work, upgrade the level of international cooperation in anti-corruption.
