试论世界贸易组织争端解决机制的合理期待原则

Study on the Reasonable Expectations Principle of WTO Dispute Settlement System

本文主要论证合理期待原则既是 GA TT/WT O争端解决机制中一个固有的原则 ,也是一个普遍适用的原则。在世贸组织争端解决机制中 ,专家小组常常运用合理期待原则来审查和认定争议双方是否有损害另一方的事实存在 ,以及双方的权利是否受到损害。与世贸组织争端解决机制的其他一般性原则不同 ,合理期待原则并未以条文的方式出现在世贸组织的有关文件中 ,但它已经渗透到世贸组织整个解释体系当中 ,该原则是解释世贸组织协定必须首先考虑的因素之一。本文对合理期待的概念 ,范围和渊源进行了初步分析 。

The Reasonable Expectations Principle is not only the intrinsic principle of GATT/WTO's dispute settlement system,but also the generally applicable one.It is used by the authority group to exam whether one side has infringed upon the other side's interest and right.This principle which is unlike the others has not been described in the documents,but embodied into the explanation system of WTO.The authors analyse its concept,range and origin,put fordward the criterion of the Reason able Expectations Principlt.
