摘要
评议是地方人大的一项重要职权 ,是人大代表人民意志、行使国家权力的行为。要提高人大评议的权威性则必须促其进一步规范化、法制化。评议工作既要符合法律精神 ,又要突出重点。但目前人大评议运作还缺乏宪法和法律的直接依据 ,其法律地位亟待提升。另外 ,还应理顺人大评议与党管干部的关系 。
In order to raise the standard of the standardization and legalization of the appraisal work of the provincial level NPC, this article does some valuable researches in four respects. First, Concerning the subject of the appraisal , the quality of the appraisal and the legal effect of the appraisal, the article advances that the appraisal is one important function and power of the local NPC and the appraisal is the action that the deputies to the NPC exercise the functions and power of the country. Secondly, Concerning the standardization of the object and content of the appraisal , the object and content of the appraisal accord with the legal spirits, as well as make the key points standout in practice. Thirdly, concerning the standardization of the function procedure of the appraisal, the article discusses three courses of the appraisal, the joint of the apprasisal with the other supervision methods of the provincial level SCNPC, the relations which should be moderated during the appraisal. Fourthly, the legal position of the appraival demands prompt promotion, it will even more benefit the legalization building of the appraisal.
