摘要
本文从民事权利构成要素的角度对配偶权作了学理上的说明。文章认为 ,配偶权系基于配偶身份而产生的夫对妻或妻对夫享有的特定化的身份权。侵害配偶权 ,行为人应承担相应的民事责任。在侵害配偶权的民事责任中 ,作者主要探讨了学界争论激烈的“第三者插足”的民事责任问题。
In this thesis,I will theoretically analyze right of consortium from its important constructive conditions,Consortium is a status privilege peculiarly enjoyed by husband and wife on basis of mateship.Infringers to consortium should burden the corresponding liabilities for tort.Among them I will mainly discuss a hot issue:the liability of a third person.
