摘要
文章遴选贵州世居少数民族布依族的婚俗习惯与法律调整现实,以新中国婚姻家庭法制建设为时代背景,结合国内外研究现状,分析了部分婚俗习惯得以在法律中留存的理论根基,并在此基础上进一步论证少数民族婚姻立法的发展与走向是法学思维理性反思的必然结果。
While New China is constructing the legal system of marriage and family, the Bouyei, an ethnic minority in Guizhou Province, is taken to do a case study on its marriage customs and legal adjustment. In the light of research status in China and abroad, an analysis is done on the theoretical foundation of some marriage customs remaining in marriage law. On the basis of the analysis, the article demonstrates that the development and trend of ethnic minorities＇ marriage legislation are decided on the rational reflection of legal thinking.
