论我国海洋立法的现状、问题及完善途径

On Marine Legislation,Problems and Perfection of China

文章回顾了我国海洋法律的历程;分析了我国海洋立法方面存在的不足:海洋法律地位有待提高,海洋法律体系内容不够健全,结构缺乏完整性和协调性,涉海法律操作性较差等;探讨了完善海洋立法的途径:立法指导思想上高度重视,构建层次分明、效力有别、科学合理而运行有效的海洋法体系,改革与完善我国海洋行政管理体制,关注国际海洋事务立法的发展,加强地方海洋立法工作力度等。

This paper discusses the current situation of marine legislation in China and analyzes the problems, which are promotion of marine legislation status, imperfect marine legislation system, fragmented and uncoordinated structure, worse operability etc. The paper proposes the following ways to perfect marine legislation： attaching great importance to the guideline of legislation, establishing clear, effective and scientific system of marine laws, reforming and perfecting marine administration system, focusing on the development of international marine legislation and reinforcing local ma- rine legislation.
