谈判的合法性和主体的独立性是保证谈判机制有效运行的基本条件。过度关注谈判的技术性而忽视谈判的合法性和独立性,是认识上的本末倒置。政府只有放弃医疗定价权,医保机构与医疗机构的谈判才具有合法性。只有管办分开,落实公立医院独立法人地位,落实医保经办机构的法人自主权,才能实现谈判主体的独立性。
