社区物业纠纷的成因分析及解决路径探讨——以天津市物业纠纷为视角 被引量:3

摘要 随着房地产业的迅速发展,社区的物业纠纷导致的诉讼案件不断的增加,鉴于物业纠纷案件的涉群体性,处理不当不但会制约物业管理行业的发展,而且会直接影响社会稳定。本文从天津市审理该类案件的情况出发,分析物业纠纷的成因,提出在完善立法的基础上,通过规范业主、物业公司的行为,强化行政主管机关的监督和管理职责,从源头上避免物业纠纷的发生,并通过完善民间调解机制化解物业纠纷,促进和谐社区的构建。 With the rapid development of the real estate industry, litigation cases resulted by residential property disputes is continue to increase. If the property disputes couldn't he treated properly, it will leave a bad impact on the development of the property management industry and the stability of social life. Starting with the situation in Tianjin, this article analyzes the causes of property disputes, makes efforts to complete law, standard the behavior of the owner and the property company, enforce the management responsibility of administrative director and avoid the property dispute from its source; this article also makes eflbrt to promote the constructing of harmonious com- munity through completing the mechanism.
