见危不救犯罪化的质疑

Question on Criminalization of not Rescuing the People in Danger

面对社会上见危不救、漠视生命的现象,有人提出我国刑法应增设见危不救罪。但当前我国刑法并不适合设立见危不救罪,因为若设立这个罪,不仅和刑法中不作为犯罪的理论相抵触,而且违背刑法谦抑性理念。

Facing the phenomenon of ignoring life in society,some people suggest that we should regulate crime of not rescuing the people in danger in criminal law.China＇s current criminal law is not suitable for the establishment of the crime of not rescuing the people in danger.Otherwise,this regulation will conflict with inaction theory and violate the tolerance of criminal law.
