民事纠纷的顺利解决必须基于正确的事实认定,这就需要当事人运用证据对事实主张加以证明。然而,对争议事实加以证明有时是不必要的,有时则是难以获得的。民事推定的存在和适用大大缓解了这一难题,在民事证明中发挥了重要作用。本文的写作将对民事证明中的推定加以界定,阐明推定适用的条件,并着重分析推定在民事证明中的作用。

The smooth settlement of civil disputes must be based on the correct fact finding, which requires parties to prove the claim of facts by use of evidence. However, it maybe unnecessary or sometimes difficult to prove the controversy facts. The existence and application of civil presumption greatly alleviated this problem and played an important role in the civil proof. This paper ineluds the definition of presumption, the elements of its application, analysis of its effect in civil proof.
