On the Litigation of Procedure of Investigation from the Perspective of Procedural Justice

程序正义是人们所公认的最基本的价值理念。侦查程序诉讼化是侦查程序存在的一种状态,更是一种发展过程。针对侦查程序进行诉讼化研究必须以侦查程序正义理念的基本价值为起点,只有这样我们才能正确剖析我国侦查程序存在的问题,以及针对这些问题对未来侦查程序诉讼化提出一些思考和建议。

Procedural justice has been regarded by the public as the most fundamental value conception. The lit- igation of procedure of investigation is a state of existence and a process of development. Researches on the liti- gation of procedure of investigation should take procedural justice as the starting point. Only in this way can we make a correct analysis on the problems existing in the inspection system in China and put forth some useful re- flections and suggestions in solving these problems.
