The quantity determination of new drugs directly effects the sentence in an analogous legal case. However the incompleteness for the quantity determination of new - type drug in the current law results in to the ambiguity and difficulty for many judicial workers practically. Based on the comprehensively analyzing some problems in quantity determination of new drugs, this paper presents a viewpoint that both the quantity and purity in new - type drugs are important factors in sentencing. Finally, some measures and suggestions are proposed.
