摘要
在美国,随着《联邦民权法案》、《雇佣年龄歧视法案》以及《美国残疾人法案》的修改完善,公司董事遭受雇员诉讼的风险进一步增大。许多保险公司抓住这一商机,在董事责任保险中附加了雇佣责任保险,还有一些保险公司则推出了独立的雇佣责任保险(EPLI)单独进行销售。虽然目前我国尚无保险公司销售雇佣责任保险,但是美国的雇佣责任立法和雇佣责任保险的发展历程,却值得我们学习和借鉴。
In the United States,with the revision and improvement of the Civil Rights Act,Age Discrimination in Employment Act and Americans with Disabilities Act,the risk of director sued by employees further increases.Many insurance companies seized this opportunity and developed Employment Practices Liability Coverage as the additional coverage of Directors ’ and Officers’ Liability Insurance,and other insurance companies developed independent Employment Practices Liability Insurance for sale.Although insurance companies don ’t sell Employment Practices Liability Coverage in China now,the course of development of the legislation of employment liability and employment practices liability coverage in the United States should be learned by us.
