2004年12月初,谷歌公司宣布了一项新的旨在创造一个图书搜索引擎的计划———谷歌数字图书馆计划,该计划自诞生之初就在全世界引发了激烈的争议。文章介绍了谷歌数字图书馆事件的发展历程,概括了谷歌数字图书馆的推崇者与敌视者观点,对谷歌数字图书馆计划进行了合理使用分析,对谷歌数字图书馆和解协议进行了评析,认为和解未必不是解决该纠纷的最佳方式。
Beginning in December 2004 Google has pursued a new project to create a book search engine （Google Book Search）. Since its inception, the project has released a storm of controversy around the globe. This article first briefly outlines the history of the Google Book Search Project, and then summarizes the supporters and opponents＂ views of Google Book Search project. After that, the author provides an analysis of the Google Book Search from a fair use perspective, and on this basis identifies Google＇s behavior of scanning in-copyright books has constituted infringement. In addition, this article comments on the Google Book Search Settlement, and holds the view that reconciliation is the best way to solve the dispute.
