城中村改造法律对策研究——以昆明市城中村改造为例

Research on the Law Countermeasures for Urban-village Renovation:Take Urban-village Renovation in Kunming City as an Example

随着城市化进程的加快,昆明市城中村改造面临缺乏统一的法律指导,地方法律法规存在许多立法缺陷,村民法律意识淡薄等困难。城中村的改造涉及众多利益主体,法律关系复杂,而行政立法是顺利改造的切入点。笔者从城中村改造涉及的法律关系入手,在完善现行法律、促进地方立法和培养失地农民法律意识等方面提出建议,试图探索建立有效的城中村改造法律制度模式。

With speeding up of kunming city urbanlization, there are many problems existing in ur- ban-village renovation process, such as without the unified legal guideline in the village, many legisla- tion defects exesting in the local administrative regulations, and weak legal awareness among farmers. The reform of urban village involves multiple interested parties, and the legal relations are complicat- ed. Administrative legislation is the breakthrough point to reform smoothly. The author analyses the law relations of current urban village reformation, putting forward proposals for the perfection of existing law, improvement of the local legislation and training legal awareness for land-losing farmer, and tries to build up an effective law system pattern for the reform of urban villages.
