论我国军婚民事保护制度的法律完善

The Legal Improvement of Civil Protection System about China's Military Marriage

我国现行婚姻法第三十三条之规定及其相应的司法解释,构成了我国独有的军婚民事保护的法律制度。该制度在维护军婚稳定、促进构建和谐军婚家庭方面发挥了一定的作用。但是这种以限制非军人配偶离婚自由权的方式来特别保护军人婚姻,其合理性越来越受到人们的质疑,且在实践中,该制度也未能真正切实有效地保护军婚。本文通过对我国军婚民事保护制度的研究分析,提出对我国军婚民事保护法律完善的建议,希望能够对完善我国军婚民事保护法律制度有所裨益。

Through the current marriage law of article thirty the legal system of unique civil protection about military marriage. - three and its judicial explanation, it constitutes This legal system plays a positive role in maintai- ning the military marriage stability, and improving the harmonious of military marriage family. However, it will pro- tect the military marriage through limit the free right of divorce for the spouse of the non - military, so many people began to suspect its rationality. In fact, this legal system doesn＇t play a real role in the protection of military mar- riage. In this paper, through discussing the theory and practice of legal system of civil protection about military mar- riage,the author gives some suggestions on how to improve legal system of civil protection about China＇s military marriage.
