论社会本位原则在经济刑法中的确立与适用

On the Principles of Social-based Orientation in Economic Criminal Law

社会整体经济效率最大化是经济法的基本原则之一,也是经济法的根本价值目标。经济刑法是刑罚手段在经济法上的运用,是经济法中的刑法,既要体现刑法的基本理念与精神,也应体现经济法的基本原则与价值追求。当前,我国过分注重经济刑法的惩罚性,对经济刑法的经济性与社会性关注不够。经济刑法社会本位原则的确立,有助于经济刑事法律制度的完善,有助于国家经济管理利益与社会利益的平衡,有助于社会整体经济利益最大化目标的实现。

Maximizing the social overall economic efficiency is one of the basic principles of economic law,and also the fundamental value of economic law.Economic criminal law is the penalty means in economic law which ensures that economic laws can be abide by,and should not only adhere to the basic concept and spirit of the criminal law,but also should adhere to the basic principles of economic law.At present,China puts too much emphasis on punitiveness of economic criminal law and pays less attention to its economic and social nature.Economic criminal law should establish and adhere to the principle of social-based orientation so as to maximize the economic interests of society as a whole.
