摘要
商品房按揭已成为我国居民生活中不可或缺的一种购房担保方式,就其来源,是从20世纪90年代开始,逐渐将香港的按揭制度模式引入内地,并结合内地的实际情况,发展成为具有中国特色的不动产担保物权制度。与香港具有英国法律特色的按揭制度相比,我国内地商品房按揭在理论基础、涵义及其类型的发展等方面,都体现出了不同的发展特点。
Commercial house mortgage has become an essential way of purchase guarantee in life of our country residents,in terms of its source,which was introduced gradually to inland from mortgage system of Hong Kong from the beginning of 1990s,and developed to realty right for security system with Chinese characteristics combined with inland actual situation.Comparing with mortgage system of Hong Kong with English law characteristics,commercial house mortgage in China's Mainland reflects different development characteristics in respects of theoretical basis,meaning and the development of types.
