随着经济全球化进程的加快,市场竞争日益激烈,专利权与技术标准属性的矛盾和冲突日益突出,通过分析专利权与技术标准之间的冲突表现,研究标准与专利之间的相同和不同属性,提出了标准与专利有机结合的理论依据及有关具体建议。

With the accelerated process of economic globalization, the market competition is becoming increasingly fierce, contradictions and conflicts between patents and technical standard attributes have be- come increasingly prominent. Based on the analysis of the conflicts between patents and technical stan- dards, as well as the same and different attributes of patents and standards, theoretical basis and rele- vant suggestions were put forward in relation to the combination of standards and patents.
