不同用途农村集体土地征收中的收益分配研究——以辽宁省辽阳市为例

Income Distribution in Different Collective Land Requisition in Rural Areas: Case of Liaoyang City,Liaoning Province

土地征收是满足社会公共利益用地需求的主要实现途径,征地补偿标准过低、征地范围随意、收益分配不合理是当前面临的主要问题。辽阳市的土地征收实践表明农民的土地权益无法得到切实保障,政府成为了土地增值收益的主要获得者,扭曲的收益分配结构造成了土地征收工作的异化。为此,需要从社会公共利益边界的明确、农民参与能力的提高、市场机制的引入、收益分配结构的优化等方面加快规范土地征收工作。

Land requisition is the main way to meet the demand of the social and public interests for land,but the low standard of land compensation,the randomness of the scope of land requisition and the irrational distribution of proceeds is the main problem.Liaoyang City's land requisition practice is further evidence that farmers' land rights cannot be effectively protected and the government became the main winner of the land value-added benefits.Distorted proceeds distribution structure caused the alienation of the land requisition work.Clearing the border of the social and public interests,improving farmers' participation,introducing the market mechanisms,optimizing the proceeds distribution structure are needed to speed up the specification of land requisition.
