论职业教育的校企合作法律保障机制及其优化

On Legal Safeguard Mechanism and Its Optimization for university-industry Cooperation in vocation Education

校企合作保障机制的构建既是当前深化校企合作的现实需求,也是推进职业教育改革发展的政策导向。校企合作活动作为一种以关系型服务合约为基础发展起来的复杂法律关系,既可以通过强化合约本身履行预期的内生型路径,也可以通过寻求外部力量、优化其组织形态的外生型路径来构建其保障机制。但是在当前的职业教育体制条件下,并没有一个通用性的法律保障机制可供采用,更为现实和合理的思路是根据校企合作的对象特征、职业院校的体制属性构建一个多元适需的保障机制。

Constructing a safeguard mechanism meets the practical needs of university-industry cooperation and guides the policy-making of professional education reform as well. As a complex legal relationship based on relational service contract, university-industry cooperation can be ensured through endogenous and exogenous paths. The former stressed the enforcement of the contract itself, the latter underlines the external forces and optimizing of the organization forms. However, there exists no universal legal safeguard mechanism under the current professional education system. To build a diversified and applicable safeguard mechanism in accordance with characteristics of college-enterprise cooperation as well as nature of professional colleges is a more realistic and sound option.
