摘要
矿业权制度是矿产资源法律制度的核心。我国于民国时期就已经制定了相关的法律制度。通过对民国时期和新中国时期矿业权的体系结构与内容的演变分析,结合当前社会发展的实际,探索出我国矿业权法律制度应朝着为人类带来经济、环境和社会效益方向的趋势发展。这对坚持可持续发展道路、构建和谐社会具有一定的现实意义。
Mining right system is the core of the mineral resources law system. Chinese had developed relevant legal system in the period of Republic of China. Through analyzing mining right system structure and content evolution of the period of Republic of China and the new era of China, combining with the current social development, this article explore the development trend of mining right legal system. It is toward the direction that brings the economic, environmental and social benefits for mankind. It has a certain practical significance for the sustainable development road and building a harmonious society.
