摘要
"院外会诊"是指医生应邀到其所注册的执业地点以外的医疗机构从事诊疗活动的行为。院外会诊分为合法与非法两种情形,合法情形即所谓"外出会诊",非法情形即所谓"走穴"。本文对邀请医院、会诊医院、会诊医生及患者在这两种情形下所发生的法律关系及各方所应承担的法律责任进行了分析。
＂Consultation out of hospital＂ means doctors are invited to some other medical institutions to engage in diagnosis and treatment services, which may be legal or illegal. Legal ones are called ＂out consultation＂, while illegal ones are called ＂moonlighting＂. This paper aims to analyze the legal relationship among the inviting hospitals, the hospitals which conduct the consultation, the consultation doctors and the patients in the above- mentioned two situations, and the legal responsibility each side should bear.
