摘要
媒体对突发公共卫生事件进行报道,虽然满足了公众知情权的需要,有利于疫情防治,但也存在对隐私权侵犯之可能,故两者间应予平衡。新闻自由及公众知情权与隐私权的保障之间并无先后顺位的差异,何项权利应优先保护,须视具体个案的情形而作具体考量。我国《传染病防治法》和《突发公共卫生事件应急条例》应当赋予新闻媒体报道突发公共卫生事件的权利,并明确隐私权的保护。
Although the media coverage about public health emergencies meets the needs of the public's right to know, and is also beneficial to epidemic prevention ,on the other hand, it increases the danger of invasion of privacy, which should be balanced .In fact, there's no general priority among the free press, public's fight to know and the protection for privacy. When it comes to the priority to fight protection, the final choice should de- pend on the condition of specific case. The Law of the PRC on the Prevention and Treatment of Infectious Dis- eases and Regulations on Preparedness for and Response to Emergent Public Health Hazards should give news media sufficient right to report the public health emergencies, and defines the protection of privacy clearly.
