摘要
在我国历史上,敦煌是我国汉族和少数民族最早接触杂居,中原文化与少数民族文化、中国文化与西方文化交融、荟萃的地区。这里独有的地理、民族与文化优势,使得敦煌民间文学艺术在融合外来文化的同时,始终坚守中华民族传统文化与本土文化内核,呈现出浓烈的地域民族性、反映世俗生活的本真性以及无限的开放与丰富的创造性;表现出了物质与非物质、平面与立体的民间文学艺术形式的多样态,展现出了多元化成果类型;体现了活态化承继。因之,也使得敦煌民间文学艺术绵延至今而弥久愈新,为我们从法律视角认知这类创造成果的法律特性,确立其可保护性和保护范围奠定了基础。
In the history of China, Dunhuang is a place where China's Han nationality and the minority nationalities live together and firstly contacted with the Central Plain's culture and ethnic culture, and where Chinese culture and western culture blended with each other. Dunhuang has unique geographical, ethnical and cultural advantages, which makes it possible for Dunhuang's literature and art to keep its national tradition while integrating with foreign culture. And this shows a strong regional nationalism, reflects the authenticity of secular life, unlimited opening and huge compatibility and a wealth of creative personality, and also forms an unique legal character of the local culture and art, displays the multidimensional states between physical and nonphysical, plane expression and solid expression, presents the plurality of outcome types and the living state of inheritance. Therefore, all of these make Dunhung's folklore unfailing, and full of vitality, creativity since the beginning of the glow of the ethnic traditional culture, which decides its legal character by which to establish its orotectabilitv and the scooe of the orotection.
