冼太夫人法制思想之探析

法制与法治存既有着密切的联系更有着本质的区别,在弘扬冼太夫人文化思想的过程中,一方面需要肯定冼太夫人历史上在法制上所发挥的积极意义,另一方面也不能人为拔高其法制思想或精神的积极意义,必须客观、中肯的予以评价。冼夫人治理过程中确实存在法制思想,但不能界定为一种法治思想,两者有着根本的不同。冼夫人法律思想中未能含有民主、自由、人权等近代价值观念,也不具有所谓法治精神要件中的"良法之治",其所处的历史时代决定了冼夫人的相关法律思想只能界定为法制思想而不能是法治思想。

The law system and the government by law have close linkage as well as essential differences. In the promotion of Mrs. Xian＇ s cultural ideology, her positive significance in the legislation should be evaluated objectively and pertinently because of her failure to contain modern values of democracy, freedom, human rights, and the so - called legislative element ＂nile of law＂. Her era has determined her legal thinking related to not a rule by law but a mere law system.
