论行政处罚法定原则对不确定法律概念的适用

On the Application of Legal Principles of Administrative Penalty to Indefinite Legal Concepts

行政处罚法定原则要求处罚依据应当明确,但法律规范中存在不确定法律概念又是客观现实。行政处罚法定原则适用于不确定法律概念造成一定困难。为实现二者相生与共,立法中应当适度限制不确定法律概念,采用定义概念的方式增加处罚依据的明确性,通过法律解释明确不确定法律概念,扩大对不确定法律概念的审查范围并减少"判断余地"。

The legal principles of administrative penalty require that statutory basis should be quite clear. Nevertheless, indefinite law concepts do exist in legal provisions. In practice, it is difficult to apply legal principles of administrative penalty to indefinite legal concepts. The following methods can be adopted to solve this problem： limiting the number of indefinite legal principles, making statutory basis clearer by defining concepts, making indefinite concepts clearer through legal interpretation, and expanding the inspection range of indefinite legal concepts to reduce the likeliness of taking advantage of legal loopholes.
