摘要
《国际足联运动员身份及转会规则》规定对于在合同保护期内无正当理由单边解约的当事人以及诱导球员在合同保护期内违约的俱乐部实施体育制裁。通过案例分析法得出,国际足联在实践中对于诱导球员违约的俱乐部,无论球员违约时间是否在合同保护期内,都将处以体育制裁。这一做法虽与当前规则有所冲突,但它有效维护了合同的稳定性。因此,《国际足联运动员身份及转会规则》第17条第4款应当予以修改。我国足球实施联赛职业化以来,存在诸多不规范之处,要实现中国足球与国际足球的接轨,俱乐部和球员必须一方面遵循《劳动合同法》的基本精神,另一方面遵守《国际足联运动员身份及转会规则》的相关规定。
According to the Regulations for the Status and Transfer of Players, sporting sanctions may be imposed on any one of the parties who terminates the professional football employment contract unilaterally during the protection period of the con- tract without just cause and on the clubs who induces the breach of contact. This article summarizes the circumstances of the sporting sanction for the clubs and players from the perspective of the decisions of Dispute resolution Chamber of FIFA through the case analysis, and then makes a conclusion that the related rules of the FIFA Regulations for the Status and Trans- fer of Players should be revised to keep good order of international professional football world. Since Chinese football went through a professional revolution, there are many non - standard places. The parties of the contract must abide by the basic spirits of Chinese labor contract law, as well as the related provisions of FIFA Regulations for the Status and Transfer of Play- ers
