德法两国弱势群体立法保护对我国的启示

作为典型的福利型国家,德法两国在弱势群体立法保护方面有其值得借鉴的地方,但由于经济增速缓慢、失业率居高及金融危机等因素的影响,其社会保障体系也存在社会保障超越国家财政能力及社会保障发展失衡等问题。通过比较德法两国弱势群体保护的利弊得失,并以此反观我国弱势群体立法保护的不足。实践中,应通过完善弱势群体立法保护体系、加强法律协调性、扩大社会保障覆盖面、缩小地区差异、提高弱势群体的社会保障层次等措施强化我国弱势群体的保护。
