从某小型商场未办理公众聚集场所开业前消防安全检查行政许可手续擅自投入使用开业,受到消防行政处罚这一普通而又具有代表性的案件出发,重点对"个体工商户"、"单位"和"公众聚集场所"等几个法律概念问题作了进一步分析,并给出了几点建议。

This paper explains some legal concepts and offers some suggestions about the definitions of ＂private busi- ness＂, ＂units＂ and ＂public places＂. The definitions are based on a typical case in which, a private business opens without being licenced by fire safety management department.
