法定证据制度与司法公正和权威的关系

The Relationship between System of Legal Evidence and Justice Fairness or Judicial Authority

公正分别为分配公正、程序公正与互动公正;权威有理论权威与实践权威、事实权威与正当权威等常见的划分。近有学者认为,法定证据制度对司法公正与权威颇有裨益。事实上,法定证据制度对司法公正和权威并无促进作用。

Justice involves distributive justice, procedural justice and interactlonal justice; authority can be divided into abstract authority and practical authority, or substance authority and legitimate authority. Recently there is scholar claims that the system of legal evidence is good to the justice fairness or the judicial authority. Actually, the system of legal evidence has nothing to do with the justice fairness or the judicial authority.
