论我国证人保障制度的完善

On the Perfection of the System of Witness Security

新刑事诉讼法规定的证人保障制度较以往有较大进步,但在保障主体、保障范围、保障方式等方面仍然存在不同程度的问题。对此,保障主体的构建不宜采用按诉讼阶段隔离式的保护方式;保障范围需针对对象范围、案件范围和客体范围三个方面完善;而保障方式则应从对证人人身和住宅采取什么样的专门保护措施,"其他必要的保护措施"的具体内容,以及证人保护与被告人质证权的协调这几个方面进行完善。

Though there is a large progress about witness security system in new criminal procedure law, many problems exist in the subjects, scopes and methods of witness security in some extent. The construction of witness security subjects should not adopt the protection pattern of discreteness according to procedural stage. The scopes of witness security should include the scope of targets, cases and objects. The perfection of the methods of witness security should include three aspects： the measures that should be taken for the personal body and residence of witnesses, the specific contents of other necessary measures, and the coordination between witness protection and the fight of cross-examination of defendants.
