面向数字图书馆的信息网络传播权优化研究

Research on Optimization of the Right to Network Dissemination of Information towards Digital Library

版权一直都是数字图书馆面临的关键问题之一。《信息网络传播权保护条例》的出台,更是使数字图书馆的发展步履维艰了。优化信息网络传播权以推进数字图书馆的发展,迫在眉睫。在评述国内外研究现状的基础上,分析了信息网络传播权对数字图书馆发展的阻碍因素。通过借鉴国外相关法律并结合我国实际情况,优化了合理使用、法定许可、著作权集体管理,并考虑到某些特殊类型作品网络传播问题,设想制定土著文化协议以完善信息网络传播权制度,促进数字图书馆信息资源的高效利用。

Copyright is still a key issue of digital library. The announcement of Ordinance on the Protection tf the Right to Network Dissemination of Information makes the development of digital li- brary faces great difficulties all the more. It＇s urgent to optimize the right of network dissemination of information, so !hat digital library develops smoothly. Based on assessing and commentating domes- tic and foreign research status, the paper analyzes the impact of right to network dissemination of in- formation on digital library. By ways of using related laws of foreign countries and according to our country~ real conditions, we optimize fair use, statutory license, copyright collective management. Considering of network dissemination issues of works of certain special types, we imagined designing indigene cultural protocol of intangible cultural heritage as to optimize right to network dissemination of information, and then information resources of digital library can be effectively utilized.
