精神损害赔偿制度是保护受害人的一项重要法律制度。《侵权责任法》对此作了明确规定。但是,由于其规定还比较保守、原则和抽象,广受学者诟病,司法实践也面临很多困境。笔者通过对精神损害赔偿的概念、性质和功能的探讨,认为应对现行法律进行修改和完善,最大限度发挥其积极作用。

Spiritual damage compensation system is a critical legal system protecting victims. Law of Tort Liability＇executed definite stipulation. Yet, owing to the stipulation＇s conventional , principle and abstract that extensively confront scholars＇ and experts＇ castigation, juridical practice also confronts dilemma. By analysis on the spiritual damages compensation and exploration on its properties and functions, the author of the essay maintained that we should amend and improve the current law and execute its positive functions in maximum degree.
