对长江流域采砂管理指导与协商机制的思考

Guiding and consultation system for sand excavation management in Yangtze River Basin

按照《长江河道采砂管理条例》和水利部有关长江委的职能规定,长江委肩负长江采砂的组织、协调和指导职责,需承担流域内河道采砂管理的指导与监督工作。通过分析现代法制理念下行政指导的特征形式,阐述长江委河道采砂管理指导与协商的实践情况,就流域河道采砂管理指导和协商机制提出设计建议。

According to the Management Regulations for Sand Excavation in Yangtze River Courses and functions of Changjiang Water Resources Commission（CWRC） stipulated by the Ministry of Water Resources,CWRC is responsible for guiding and supervising of sand excavation in Yangtze River Basin despite of organization and coordination.Practices of directing and coordinating sand excavation in the Yangtze River Basin are introduced based on analysis of features of administration under the model legal concepts and recommendations is given for the design of guiding and consultation system.
