On the Equal Right to Development of Chinese farmers——The Evolving Legal Statusfrom Migrant Workers to Citizens

农民工的民生问题是当下中国民生问题的焦点。市民身份的缺失不完全是法律规范与文化认同上的缺失,而是一种基于集体人权的权利缺失,其中最根本的是农民工发展权的缺失。应当建构基于发展权的"五位一体"的整体性权利体系,通过全面清理现行规范体系,从定性、定位、原则、主体、权利与义务六大方面创设一部综合性农民工权利保障法律文件。

The livelihood problems of migrant workers is the focus of the current livelihood issues.Lack of citizen identity is not completely the lack of legal norms and cultural identity,but a lack of the right based on of collective human rights,the most fundamental of which is the lack of the right to development,It shall establish the system of rights that has integrity based on the right to development,through comprehensive clean-up the existing system of norms,create a comprehensive legal documents for protecting farmers＇ right from the qualitative positioning,in principle,the main rights and obligations.
