The Trend of Basic Rights Theory Since the Implementation of the Constitution in 1982

"82宪法"实施以来,基本权利理论逐渐成为宪法学理论研究的重要内容。发展至今,中国宪法权利理论的研究成果已经颇具规模。随着理论研究的不断深化,基本权利理论出现了体系化和精致化的趋势。随着研究方法论的不断的成熟,基本权利理论从简单的借鉴国外理论逐渐发展为中国问题导向的研究。未来的基本权利理论研究的一个重要课题就是如何将基本权利的一般原理与中国的宪政实践相结合,逐渐形成一套对中国现实具有解释力的基本权利理论和范畴体系。

Since the implementation of the Constitution of PRC,basic rights theory has gradually become the most important contents of the constitutional theory.Up to now,basic rights theory is forming system and becoming more refined gradually.With the continuous deepening of research,the research method of basic rights develops to Chinese problem oriented instead of simple to draw lessons from foreign theory.In the future,the most important task of basic rights theory is to integrate the general principle of basic rights and Chinese constitutional context and to construe basic rights doctrine according to Chinese society.
