摘要
集体谈判是劳动者利益代表——企业工会或产业工会与资方组织之间就关切双方利益的实质性条款与程序性条款进行反复谈判与信息决策的过程。三方协商机制是政府、企业方和工会方就各方关心的问题在国家层面、地区层面或行业层面进行利益博弈和信息决策的过程。本文从博弈论的角度出发,分析了集体谈判双方的自主博弈过程及产业工会干预下的双方反复博弈过程,对劳资双方组织博弈和企业劳动关系运作进行初步探索,并探讨劳、资、政三方协商过程中的三方博弈行为,分析了理性人假设条件下各方如何实现各自长期效用的最大化,期望对了解劳动关系的运作机理有所帮助,对促进劳动关系的和谐提供一个新的思考角度。
Collective bargaining is the representative of the interests of workers——between enterprise unions or industrial unions and employers organizations concerned about the interests of both sides to frame the substantive and procedural provisions of article repeated the process of negotiation and decision-making information.Tripartite negotiation mechanism is an interest game and the decision-making process based on information,government,enterprise and the union for all parties' concern on the national level,district level or industry level.From the perspective of game theory,the paper analyzes the collective bargaining process and the two independent game industrial unions' intervention in the process of repeated games under the two sides,both employers and employees organizations,game and initial operation of labor relations,explores the game behavior in the three parties consultation process,and analyzes the way of sensitive people of respective parties under assumptions to maximize the expected long-term utility,to understand the operational mechanism of labor relations,and to provide a new thinking angle in promoting the harmonious labor relations.
