基本农田发展权分配制度与保障体系建设简论

Distribution system and security system construction of basic-farmland development rights

现行基本农田制度的主要缺陷是发展权制度缺失。这限制了农民务农收入的增长,导致地方政府滥用征地权。基本农田发展权制度建设既应包括基本农田用途管理制度、基本农田征用制度、土地出让金分配制度建设,也应包括基本农田发展权有效实施的保障体系建设,如农业生产发展目标体系、农业生产发展考核体系、农业发展监督体系等。

The main defect of current basic farmland institutions is that peasants have no develop rights, which restricts the growth of peasant farming income and causes the abuse land rights of local government. This paper proposes that the system construction of basic-farmland development rights should include following aspects： land use management system, solicit system, distribution of land leasing and security system that guarantees the basic-farmland development rights.
