海南西部地区刑事附带民事诉讼案件审理的调研报告

Subject and Scope of Compensation in Supplementary Civil Action in Criminal Proceedings in Western Areas of Hainan

通过对2009年1月至2011年4月海南省第二中级人民法院(及辖区法院)审理的刑事附带民事诉讼457件案件中关于赔偿主体及赔偿范围等司法实践中暴露出的问题,进行相关分析,提出立法建议,希望能对刑事附带民事案件的审理及完善刑事附带民事诉讼制度有所借鉴。

Related theoretical analysis was made of the problems in the judicial practice of compensation subject and compensation scope of 457 cases of supplementary civil action in criminal proceedings tried by the Second Intermediate People＇s Court of Hainan Province （and the basic level courts in the areas） In January 2009 to April 2011. Legislative suggestions were put forward, hoping to provide references for the trial of criminal supplementary civil case and perfection of supplementary civil action in criminal proceedings.
