当代国际法发展的文化之维

The Cultural Dimensionality of the Development of Contemporary International Law

国际法作为一种制度,产生于人类早期各个地域文明。然而,作为一门学科,国际法却发轫于近代的欧洲大陆。伴随着西方自由资本和市场在全世界的扩张,国际法开始逐步适用于欧洲大陆之外的国家,从而在适用的主体及空间范围上获得了超越各个地域文明的普遍性意义。从此,随着国际关系的不断发展,各个不同民族文化之间的激烈碰撞和交流开始深刻影响着国际法的发展。尤其是二战结束以来,文化开始日益成为当代国际法发展过程中的一个突出维度,这主要体现为三个方面:一是文化主权概念的兴起及发展;二是文化权利的产生和发展;三是文化遗产概念的出现及发展。

As a regime, international law was produced in each regional early civilization. However, as a science, international law emerged in Eurorean continent in modern time. With the expansion of the Western free capital and market in the world, internati real law began to apply to the countries outside the European continent, and then, international law began to realize the transformation from regional international law to universal international law. Since the end of World War II, culture begins to become a prominent dimension in the process of development of the contemporary international law. This is mainly embodied in three aspects： first is the rise of the concept of culture sovereignty and its development; second, it is the birth and development of cultural rights; the last is the emergence of the concept of cultural property and its development.
