摘要
弹性退休的法律规制应该以人权理念导向的强制与自愿结合为目标,以公平基础上的分类设置、利益衡平下的可操作性为基本原则,选择最相适宜的立法模式,保障男女平等的劳动权与退休权,规定男女平等的退休年龄,合理确定最低及最高法定退休年龄,以及相应的法律救济方式。同时,要求公正、稳妥的法律规制程序,并有配套的制度与措施的跟进。
The legal regulations towards the flexible retirement system should target at the combination of the guidance on citizens' compulsory and voluntary concept about human rights, at the basic principle of classification based on fairness and feasibility based on balance interests. This system chooses the most suitable legislative model to safeguard the equal rights of labor and retirement between males and females, to regulate the equal retirement age between males and females, and to reasonably determine the lowest and highest age of retirement and the corresponding remedies. Also, this system requires equitable and stable legal legislation procedure followed by supporting systems and measures.
