论当前我国社会转型中版权制度创新的困境与出路

Problems and Solutions in China's Copyright System Innovation in the Course of Social Transformation

伴随着我国社会经济、政治、文化的全面综合转型和"互联网精神"在全社会各领域的全方位导入,已使我国现有的版权制度难以满足现代社会公众多层次、多元化的利益需求,也凸显出版权授权模式异化和规避,新兴产业边界模糊与监管机制不完善,政策与法律法规执行不力,利益关系错综复杂,公平分配艰难,侵权隐蔽性高、风险较低,举证责任沉重、诉讼成本高昂与赔偿标准过低等诸多问题。进一步发展和创新我国版权制度的出路在于构建新型版权授权模式,完善版权管理体制和监管机制,强化政策与法律法规的执行力和有效性,加快版权领域的全面立法,正确处理多元主体之间的利益关系,建立和完善强有力的版权多元保障机制,坚持创新,形成具有中国特色的版权制度体系。

Along with the comprehensive transformation in China's economy,politics,culture and the overall penetration of 'Net Attitude' in each domain of the whole society,the existing copyright system in China has failed to meet the multi-level and diversified needs of the public interests.string of problems has sprung up.Correspondingly,further improvement and innovation in China's copyright system lies in such solutions as the construction in a new mode of copyright authorization,the perfection in management system and supervisory mechanism of the copyright system,the enforcement in implement and effectiveness of policies,laws and regulations,the acceleration of comprehensive legislation in the field of copyright,the proper management in relationship of the interests between different multiple subjects,the establishment and improvement of a forceful multiple security mechanism in copyright,the adherence to innovation and the formation of a copyright system with Chinese characteristics.
