A Study of the Problems of the Antimonopy Law in Network Competition

近期诸多的网络纷争事件,暴露出网络市场法制建设的不完善。本文在结合反垄断法理论的基础上对网络市场的问题进行了深入剖析,认为对界定垄断行为的两大构成要件市场支配地位和滥用其支配地位方面反垄断法规定的不足,并结合欧美先进的立法经验提出了进一步完善的建议。

Recently, many network disputes events have exposed the imperfection of the legal system in network market. In this paper, a deep anlaysis of the problems of the network market combining with the theory of anitimonopy law is conducted, pointing out that define the two big monopoly constitutive requirements of dominant market position and abuse the control position of the shortcomings of the antimonopoly law provisions, and combined with the advanced legislative experience of Europe put forward some Suggestions on perfecting.
