摘要
以合同法理为出发点,分析国际上有影响力的工程合同条件,得出现代工程施工合同条件变更应遵循定价在先、维持投标报价水平、公平计价原则的结论,并发现国内现行标准施工合同条件常常忽略这些原则,特别是没明确体现定价在先原则,应当加以改进。
Starting with jurisprudence of contract,analyzes the conditions of some influential international engineering contracts,obtains that valuation principle of contracts variation should include pre-pricing,keeping bidding level and fair valuation,and finds out china＇s engineering contracts lose sight of these principle,especilly pre-pricing,so that should be improved.
