关于保障农村集体土地权益的思考

Thoughts on the Protection of the Rights and Interests of Rural Collective Land

随着我国城市化进程的加快,出现了违法违规侵占土地现象,农民土地合法权益难以保障等问题。文章结合案例进行研究和分析,提出解决问题关键在于对现行的有关土地法律法规和土地管理制度进行修编,实现土地资源市场化、一元化管理,以适应城市化和新农村的建设。不断完善规范农村集体土地所有权制度和用地合法流转程序,逐步推进国家土地所有权和集体土地所有权一元化统一管理;建立健全监督机制,大力普及农村法律知识,提高村民依法维权意识,拓宽农民维权渠道,最大限度保障农民的土地合法权益。

With the acceleration of the urbanization process in our country, there have emerged cases of the failure to safeguard the legitimate rights and interests of farmers＇ land as well as the illegal seizure of land, etc. This paper, based on case studies and analyses, opines that the key to solving the problem lies in editing and revi- sing current laws and regulations on land and the land management system, and in implementing the marketization and the centralized management of land resources so as to adapt to urbanization and new rural construction. There- fore, efforts must be made to constantly improve and standardize the rural collective land ownership system and the legal land transfer program, to boost gradually the centralized and unified management of state land ownership and protecting farmers＇ rights and to maximize the protection of farmers＇ land rights.
