摘要
我国劳动合同法明确规定了企业可以通过与劳动者签订保密协议和竞业限制协议的措施来保护企业商业秘密。但由于我国劳动合同法关于商业秘密的规定过于原则,因此实践中存在许多问题值得探讨。完善我国劳动合同法关于用人单位商业秘密保护的规定,科学界定商业秘密的权利主体及义务主体。
It is clearly stipulated by the Labor Contract Law that enterprises can sign confidentiality agreements and non-competition agreements with the laborers in order to protect corporation's commercial secrets. However, the provision on commercial secrets in China's labor contract law is too simple and rigid, so there stands many practical issues worth exploring. It is very important to perfect the provision of the China's labor contract law about the protection of employer's commercial secrets, and define the subject of rights and obligations between the parties in the commercial secrets relationship.
