Understanding about Informed Consent and Its Legal Liability from the Medical Humanity Perspective

本文结合医患关系、人文医学、医学伦理等问题,从医患沟通与知情选择的法律规定,依法行医的法规内涵,从医学人文视角来学习领会《侵权责任法》的相关内容,探讨了医患沟通、知情告知、医疗过错损害责任在法学上的因果关系,以及医生在医患沟通关系中应当承担的法律责任。

This paper interprets the relevant contents in ＂Tort Liability Act＂ from the perspectives of medical humanities such as doctorpatient relationship,humanistic medicine,medical ethics and the promulgations in laws for doctor-patient communication,informed choice and medical practice in accordance with the law and regulations,explores the legal causality between doctor-patient communication,informed consent,responsibility for damage incurred by medical errors and the legal responsibility of a doctor in the doctor-patient communication.
