国际法院参与下的国际司法干涉——以“比利时诉塞内加尔案”为切入点的研究 被引量:1

摘要 2012年7月国际法院在"比利时诉塞内加尔案"中确认了与"哈布雷案"无实际利益关系的比利时基于共同利益而享有出庭权,使得国际法院明确参与到国际司法干涉中来。相比国家层面和国际刑事司法机构层面的司法干涉,通过国际法院进行的司法干涉在干涉范围上更具广泛性,不再仅限于国际刑事犯罪领域,还可能涉及环境保护、公共利益等领域,是一种新型的国际司法干涉,将对国际社会产生重要的影响。鉴于我国目前所处的复杂国际环境,我们必须关注国际司法干涉的这种新发展,并从各个层面做好准备。
